Judicial Watch: Federal Court Orders Hillary Clinton to Answer Additional Email Questions Under Oath

(Washington, DC) –Judicial Watch announced today that U.S. District Court Judge Emmet G. Sullivan ruled that within 30 days Hillary Clinton must answer under oath two additional questions about her controversial email system.

In 2016, Clinton was required to submit under oath written answers to Judicial Watch’s questions. Clinton objected to and refused to answer questions about the creation of her email system; her decision to use the system despite warnings from State Department cybersecurity officials; and the basis for her claim that the State Department had “90-95%” of her emails.

After a lengthy hearing yesterday Judge Sullivan ruled that Clinton must address two questions that she refused to answer under-oath.

Describe the creation of the clintonemail.com system, including who decided to create the system, the date it was decided to create the system, why it was created, who set it up, and when it became operational.

During your October 22, 2015 appearance before the U.S. House of Representatives Select Committee on Benghazi, you testified that 90 to 95 percent of your emails “were in the State’s system” and “if they wanted to see them, they would certainly have been able to do so.” Identify the basis for this statement, including all facts on which you relied in support of the statement, how and when you became aware of these facts, and, if you were made aware of these facts by or through another person, identify the person who made you aware of these facts.

Judge Sullivan read his opinion from the bench, deciding that the question about the creation of the email system was within the scope of discovery. Judge Sullivan rejected Clinton’s assertion of attorney-client privilege on the question about the emails “in the State’s system.”

The court refused Judicial Watch’s and media’s requests to unseal the deposition videos of Huma Abedin, Cheryl Mills and other Clinton State Department officials. And it upheld Clinton’s objections to answering a question about why she refused to stop using her Blackberry despite warnings from State Department security personnel. Justice Department lawyers for the State Department defended Clinton’s refusal to answer certain questions and argued for the continued secrecy of the deposition videos.

This hearing and court ruling is the latest development in a Judicial Watch Freedom of Information Act (FOIA) lawsuit about the controversial employment status of Huma Abedin, former deputy chief of staff to Clinton. The lawsuit, which seeks records regarding the authorization for Abedin to engage in outside employment while employed by the Department of State, was reopened because of revelations about the clintonemail.com system (Judicial Watch v. U.S. Department of State (No. 1:13-cv-01363)). The court also granted discovery to Judicial Watch to help determine if and how Clinton’s email system thwarted FOIA.

“A federal court ordered Hillary Clinton to answer more questions about her illicit email system – which is good news,” said Judicial Watch President Tom Fitton. “It is shameful that Judicial Watch attorneys must continue to battle the State and Justice Departments, which still defend Hillary Clinton, for basic answers to our questions about Clinton’s email misconduct.”

Okay, looks good on it’s face. My conclusion would be the insult this whole thing is to our system of justice. Here we had Clinton commit violations that were far outside the law.

So now because of the fact she did it all under the job title she was in, the government has to come in to defend her actions and explain her egregious conduct. (Excuse my barfing”) It is so outrageous that both the DOJ and Dep of State could be called in to defend her conduct. And of course they have to do it at our taxpayers’ expense, too. A double.

But that is the way this whole thing goes and Hillary knows it. She sewed the seeds of it into the State Dep. She knew and planned this. You have to wonder if this makes State accomplices to her crimes? And if Barry Soetoro is also liable for having allowed it?

Then the last salient point: why do we continually always find about this mostly through Judicial Watch when we had active Congressional investigations, and presumably DOJ investigations as well? Yet here they are in battle for answers some 5-1/2 years later.

No wonder Hillary’s new theme is “Onward Together.” She commits the offenses then drags everyone along, forced to defend her every step of the way. “Togetherness” that way has always been one of endearing benefit to the Clintons.

The Comey problem: same as the old one

I will not bash Conmey for reopening the Clinton investigation, but results do mater. How quickly Dems have turned on their pillar of integrity they’ve been touting for months.

Comey has put himself in a box. He made a wrong decision in July, now he reopens his flawed investigation. So what do we expect? Well, he has new information that does not change his original determination in July. No matter the new evidence, he will likely come to the same conclusion — rather than admit his conclusion was flawed in the first place.

He had little choice but to bring it forward. I expect this will just get buried in the same way and place that the other information got deep-sixed.

Comey’s only real choice forward now is to be consistently wrong, at least regarding the email server situation. His problem is how to explain it? Though taking a different position now could jeopardize any integrity of the first conclusion that Dems went gaga over. So he has a huge explanation problem.

Remember the main crux of this current debacle is that he said in his July statement that the investigation was completed. In his rush to put a period on the sentence, then, he prematurely shot himself in the foot. Now he has to declare, whoops it isn’t complete “I’m going to reopen it.” Though he already set the precedent and standard to dismiss, explain away, or marginalize even this new evidence and information. How does he do all that?

Aren’t you glad you are not James Comey? No matter what, he is going to piss off at least half the people in the country.

However, the last major problem is still Dep of Injustice which proves unwilling to prosecute. Could they prosecute Huma instead of Hillary? I have doubts. We already know they have refused to prosecute it. So then, what does even new information mean? It means the same treatment as the old information. It only makes the DOJ look even worse than it already does. We have a politicized and radicalized government.

In conclusion one can say, in other words, that the FBI’s pointless investigation into nothingness continues. Be it officially declared and noted this day of 2016! In the end Hillary wants to use the fact that the investigation went nowhere to confirm her innocence — much as I detest that result. And she’ll use it as some kind of accomplishment, having navigated another investigation.

The question is not whether Hillary Clinton is above the law, but how far above the law she is. See what the seeds of corruption have brought us?

What a tangled web she weaves, when at first she practiced to deceive. Hillary has had a few encounters with reality along her campaign trail in the last year and half. But at every one she took the road not traveled to obfuscate it. Then she blamed others for her own scandalous behavior. Yet she always says she is claiming responsibility. Lie.

She wants to create the illusion of accountability.

Hillary claims she apologized for the server mishap. Well, she said it was a mistake. A four year long, two-year investigative one. That didn’t stop or curtail her lying about it. The people found out just weeks before the Democrat convention that she was not being charged for anything. Surprise!

BREAKING: After Endorsing Clinton, Obama Admin Calls FBI’s Email Investigation ‘Criminal’

And that’s why the President when discussing this issue in each stage has reiterated his commitment to this principle that any criminal investigation should be conducted independent of any sort of political interference and that people should be treated the same way before the law regardless of their political influence, regardless of their political party, regardless of their political stature and regardless of what political figure has endorsed them.

Clinton has worked to downplay the seriousness of the investigations since the earliest days of questions concerning allegations that she maintained the email account in order to obscure shady dealings with foreign nationals to sell them influence in exchange for contributions that would help finance her inevitable bid for the presidency.

However, Clinton has augmented her denial efforts in recent weeks after the release of a damning Inspector General (IG) report that maintains that Clinton did, in fact, break federal law in refusing to “comply with the Department’s policies that were implemented in accordance with the Federal Records Act.“

In essence, the report clarifies that whatever the DOJ decides to do, the evidence shows unambiguously that Clinton had pledged to conduct State Department business in accordance with the department’s policies for protecting sensitive materials and that she failed to do so thousands of times.

In this matter, intent is irrelevant. Even if we accept that it was a supposed mistake, the end result is the same: she violated the law and has continually insisted that she did not, in fact, violate the law. Her actions were not merely violations of the Federal Records Act, but also of the Espionage Act’s 18 USC 793, known by many as the “gross negligence” statute.

There we have Obama defending that investigations should move forward irregardless of politics, and not be swayed by politics, as professionals.

Federal Records Act — this is something that apparently seems to be lost on Democrats and many in MSM.

What are records?

Records include all books, papers, maps, photographs, machine-readable materials, or other documentary materials, regardless of physical form or characteristics, made or received by an agency of the United States Government under Federal law or in connection with the transaction of public business and preserved or appropriate for preservation by that agency or its legitimate successor as evidence of the organization, functions, policies, decisions, procedures, operations, or other activities of the Government or because of the informational value of the data in them (44 U.S.C. 3301).

44 U.S. Code § 3101 – Records management by agency heads; general duties

The head of each Federal agency shall make and preserve records containing adequate and proper documentation of the organization, functions, policies, decisions, procedures, and essential transactions of the agency and designed to furnish the information necessary to protect the legal and financial rights of the Government and of persons directly affected by the agency’s activities.

44 U.S. Code § 3301 – Definition of records

a) Records Defined.—

(1)In general.—As used in this chapter, the term “records”—

(A) includes all recorded information, regardless of form or characteristics, made or received by a Federal agency under Federal law or in connection with the transaction of public business and preserved or appropriate for preservation by that agency or its legitimate successor as evidence of the organization, functions, policies, decisions, procedures, operations, or other activities of the United States Government or because of the informational value of data in them; and
(B) does not include—
(i) library and museum material made or acquired and preserved solely for reference or exhibition purposes; or
(ii) duplicate copies of records preserved only for convenience.

(2)Recorded information defined.—

For purposes of paragraph (1), the term “recorded information” includes all traditional forms of records, regardless of physical form or characteristics, including information created, manipulated, communicated, or stored in digital or electronic form.

Then further guidelines and description. And it does include email and has for years.

18 U.S. Code § 2071 – Concealment, removal, or mutilation generally

(a) Whoever willfully and unlawfully conceals, removes, mutilates, obliterates, or destroys, or attempts to do so, or, with intent to do so takes and carries away any record, proceeding, map, book, paper, document, or other thing, filed or deposited with any clerk or officer of any court of the United States, or in any public office, or with any judicial or public officer of the United States, shall be fined under this title or imprisoned not more than three years, or both.

(b) Whoever, having the custody of any such record, proceeding, map, book, document, paper, or other thing, willfully and unlawfully conceals, removes, mutilates, obliterates, falsifies, or destroys the same, shall be fined under this title or imprisoned not more than three years, or both; and shall forfeit his office and be disqualified from holding any office under the United States. As used in this subsection, the term “office” does not include the office held by any person as a retired officer of the Armed Forces of the United States.

Remember the famous Nixon quote?

Washington: On the eve of the convention at which Hillary Clinton is to be confirmed as presidential candidate, the Democratic Party has been plunged into crisis – the US media is brimful of ugly and embarrassing stories from within the party’s head office, all based on 20,000 emails dropped on Friday evening by the anti-secrecy group WikiLeaks.

The correspondence seems to confirm allegations by the campaign of defeated Senator Bernie Sanders that the Democratic National Committee was actively rooting for Mrs Clinton to win, a revelation that will most likely serve as a wedge between the two camps and make it even more difficult for her to persuade Sanders voters to support her.

She walks, she talks, she fundraises

Hillary now looks to shore up support(pardon the pun) in the wake of the server seizure. So she is going on a fundraiser vacation, renting a 12 million dollar mansion in “the Hamptons” where they plan to raise lots of cash. The high style of the 1%-ers.

The cost is 100,000 for two weeks…or is that called an investment? Funny how they go on vacation and the money rolls in. That’s not how it works with most people, unfortunately. But nothing Clintons do is like normal people. Going on a fundraiser vacation just makes lots of sense(cents). Even impressive by the “lifestyles of rich and famous” standards.

But nothing with them is normal. They prefer the absurd, extreme, eccentric and extravagant even in politics. They should look around and ask themselves, “how did we become 1%-ers? The prior video was a perfect example. There are times when we occasionally get to see exactly how liberals think — flawed as it is.

There you see media liberals grieving and prognosticating on the political fallout over Hillary’s self-created servergate. Not unexpected but then listen to co-host Mika Brzezinski and let it sink in. There is a transparency and brutal honesty to it.

Mika sounds disgusted sighing in the background. She wonders to the others about how candidates can pretend things(scandals) don’t exist? That might be a good question for Hillary. So after Hillary candidates tell you those things don’t exist, you are supposed to believe them. Then she asks “do they really think the American public is that stupid?” She says “that is very insulting.”

Well, Mika does have some real points. People must accept their denials or excuses. They really do think the public is that stupid. Mika explains the way it works for Dems and leftists. With a sigh she admits that in spite of these problems if Hillary can get the nomination, “I will [still] vote for her.” See, that’s how it is supposed to work for Hillary and Obama. So the only question then is how does she get there?

Hillary Clinton’s communications director Jennifer Palmieri wrote that it’s all nonsense.

“The bottom line: This kind of nonsense comes with the territory of running for president. We know it, Hillary knows it, and we expect it to continue from now until Election Day.”

And according to NY Post, 52% of people polled say Hillary’s email ordeal “should be subject to a criminal investigation.”

So the only objective is for Hillary to get the nomination, however she can. Then, Democrats will still vote for her. That makes the nomination, by any means, the only objective. That’s how it worked so far. She asserted herself as the anointed one, early and often, as the heir apparent. For so long that they all believed her and no formidable challenger came. She locked up support.

But it was also based on stalling along the way. Stall investigations, stall opposition to the point where they finally have no other choice but her. Even if these problems surface, by then she’ll be their only choice. That’s what she wants and got. Obama built his election on the same inevitability premise.(belief) Make the thing, or person, so inevitable there’s no choice. Basically, the theory goes, people do not want to not believe.

The strategy is stall to prevail. After that it becomes only a series of events granting her the prize. Then, nothing that led up to it matters at all. In the end, people will have no choice. The beauty is Democrats fully admit they will still vote for her, no matter what truth outs. It is only a matter of means, just as Hillary believes it is only a matter of getting to the White House. Once there, the means shall matter not one bit. If it takes coming down with a nasty case of lies.(as Islamists justify jihad) After all, she expects Democrats to lie to themselves in order to support her.

Meanwhile, Hillary does the Hamptons. And any means necessary to nimination. Once achieved all the means suddenly become irrelevant. Just like the va-k in the Hamptons.

What problem?

I opted for convenience… it didn’t seem like an issue. Only after I left, they asked and I provided my emails.

We went through and delivered them. You don’t want to see my Yoga routines, trust me.

I don’t know why all the fuss?
I told the State Depart to make public whatever I(we) gave them.

I met all my responsibilities. I complied with all the rules.

 

Now as far as needing to see the server, I have no problem with that….

Hillary’s mountain of problems

The White House declares Obama did not know and only found out through the press. Play it again, Sam. Doesn’t say much for his administration, does it?

That’s only half of the problem, if we take Obama at his word. That Hillary did not disclose or notify them is a sub-problem. Why not? And he did not find out. Why not?

So Hillary supposedly did not inform the Obama administration that she was exclusively using private email and routed it to her home.(wherever) Wouldn’t security and national security demand that she tell them, or Obama?

I actually speculate that there was some sort of conversation. This is only speculation, and only one possibility. It could have went something like Hillary letting him know basically what she was doing, ‘but just for security reasons'(wink). He might have said if there are ever questions or problems, I have deniability. Even if there was no conversation it amounts to the same thing, “I didn’t know”.

What if every cabinet Secretary did that? This was not the occasional overlapping of private email accounts. When they point to Jeb or Christie, those are states and not the federal government or a department.

The other problem is that State Department certainly knew it. But no one informed the administration of the situation?

As with most Clinton problems, people want to close the barn door after Clintons bolted through it. She has her way and benefits, then takes a stand in favor of closing the door.

Grab a cup of coffee and sit down, man do I have a far-fetched story to tell you. No, they haven’t landed on Mars….yet anyhow.

But you remember that Hillary Clinton, who was running for president in ’08, and all the flack she got about her records? Or do you remember her when Bill was president, how there were all those document problems? Heck, I still don’t know if they found them all. Wasn’t there a closet, basement, law office files and lots of boxes — here and there?

Well, you know how she was Secretary of State and high profile for years running the State Department? Well, it turns out she set up all her email addresses outside the official State Department. Why do you suppose she’d ever thinnk of doing that? An old hand at record chases and archives ought to have something to do with it. But the best part is she set up the servers for it at her house in Chappaqua. Did you ever hear anything so weird?

Now you and me both know the Clintons are no perfect politicians but this takes the cake, after all the troubles she had over her records — or lack thereof — before. Then you know Bubba runs the Clinton Global Initiative.”The mission of the Clinton Global Initiative is to turn ideas into action.” Sure he’s busy running that and money is flowing, like it always does with the Clintons. Well, except when they are dead broke – which must be often.

Anyways, all this has me thinking what the hell is wrong with her? I mean she knows you can’t just do that and opt out of the governmental system of things. Doesn’t she know her boss, Barry, is the only one who can truly hide his records and get away with it, without people making it a big deal? But Hillary now, she has some ‘splaining to do.

Still, even the record obfuscator, Barry would be aware she was doing that. I mean the guy spent half of his first campaign chasing down Hillary’s records to attack her. Now she must have had some reasons to do that, obviously. She didn’t want the public prying into the records. Maybe she didn’t want her boss looking over her shoulder keeping tabs on her? Never know, but that is the point, why? I hear she never much trusted him, and I don’t think he did her either. Nor was Bubba happy with team Obama after that deal in South Carolina labeling him a racist. Then Bill said ‘this whole thing is the biggest fairytale I’ve ever seen.’ Talk about fair tales. I suppose he might be over that by now.

So why do you suppose she would go to all that trouble to keep her emails out of the loop? And since she quit State she’s been pretty quiet what with working with Bill in the Foundation and all, and busy raising money for her campaign I mean the foundation, or something like that. See if all those emails and stuff was sitting there in servers in the house, it would be in the same place as Bill and the foundation’s business. It’s all sort of confusing, isn’t it? I mean I can’t figure this out. Bill was the one we used to call slick Willy. You suppose he had access to all that information of State too? Does that conflict with what he is working on?

“The White house guidance is,” according to Josh Earnest….oh never mind, what difference at this point does it make anyway?

Get this, then she went around the State Dep. lecturing her own people to not use private email accounts. I guess no one there asked her about hers. Funny. What could be going on there? It’s only water-cooler talk now, you know how people do when something new goes around. At least two key people knew it all along, Obama and Hillary. Three with Bubba. So if most everything was sent to her that would be a huge amount of data, wouldn’t it? I mean they’d have to be industrial sized servers these days with the amounts of email, especially as the Sec of State.

The thing that gets me is the big Global Initiative and the Clinton Foundation that Hillary’s been helping out with. I bet many of the same places and people are overlapped in both the Foundation and State. Seems like it would be a giant web, oops that’s the wrong word.

The cover story is an inference from State that the issue is broader than Hillary:

On Tuesday, Harf said, “We reached out to all of the former secretaries of state to ask them to provide any records they had. Secretary Clinton sent back 55,000 pages of documents to the State Department very shortly after we sent the letter to her. She was the only former secretary of state who sent documents back in to this request. These 55,000 pages covered her time, the breadth of her time at the State Department.”

It just gets curiouser and curiouser with those Clintons, doesn’t it? There always seems to be large amounts of money involved too, no? I can’t wrap my head around how all this fits together. There’s former president Bill, and Hillary sets up servers directing all her State Department info there. He’s sitting there beside it saying what is she working on, I wonder? Then she is set to run for president unchallenged. Tricky Dick had nothing on Hypocrite Hillary. She crossed that bar long ago.

CMS Administrator Told Subordinates to ‘Please Delete’ White House Email

CMS Administrator Marilyn Tavenner told two subordinates to “please delete” a forwarded email conversation between Tavenner and a group of White House advisers which took place days after the disastrous launch of healthcare.gov.

The House Energy and Commerce Committee published the October 5, 2013 email today. It contains a discussion Tavenner had with White House health care policy adviser Jeanne Lambrew and several other White House advisers including White House Chief Technology Officer Todd Park. Tavenner forwarded the email chain to the CMS spokersperson and another subordinate saying “Please delete this email-but please see if we can work on call script.” Another short sentence that followed this has been redacted.
